1. Reservations:
Reservations are accepted up to when all vacancies
are fully booked and they will be considered valid,
with the drawing up of a contract, only at the time
of the confirmation written on behalf of the Holding
Tour Srl, which will be given or sent directly to the
client.
2. Deposit:
At your arrival you must pay a deposit which will be
given back to you at the time of your departure after
checking the flat's condition.
3. Membership Fee:
For every reservation one must pay over to the organization
a membership fee that costs €16,00 for each person,
for the booking charges; Eurant enrolment.
4. Payments:
Upon your booking you will have to pay in advance 30%
of your sharing fee as well as your enrolment fees (these
are not refundable not even if there is a cancellation),
whereas the balance will have to be paid at least 30
days before your departure. For all enrolments made
within the 30 previous days of your departure, the entire
amount must be paid at the moment of your booking. The
non-fulfilment of the payments mentioned above establishes
a rescinding clause underlined in the contract, as such
to determine the resolution, except for the compensation
for the damages suffered by the organizer.
5. Withdrawal of a Client:
The client who withdraws from a contract will not only
have to pay both their sharing and enrolment fees, but
they will also have to face the following penalties:
whether it is a group of people or an individual holiday
in any type of Hotel, Flat or Residence
10% up to 30 days before the departure
20% from 29 to 21 days before the departure
50% from 20 to 11 days before the departure
75 % from 10 to 3 working days before the departure
100% after the above limits
In any case, no refund will be given either to whom
may not show up at the departure or to whom might resign
during the actual holiday. Therefore not even a refund
is due to those who are unable to fulfill their holiday
due to the absence or the invalidity or the insufficiency
of the expected identity papers.
6. Transfer of a Contract:
The client can be replaced by another person as long
as he or she is able enough to satisfy all the conditions
for the use of the service within the relations coming
from the contract, provided that you inform the organizer
within 4 working days and no later than before the departure
together with the personal details of the transferee.
The transferor and the transferee are firmly forced,
towards the organizer, to pay the price and further
charges coming from the transfer itself.
7. Non-Performance:
The organizer can cancel the contract either totally
or partially, without any allowance, for exceptional
circumstances. In this case, a full refund of the amount
that has been paid is due to the client, except for
any other allowance.
8. Reports and Complaints:
A penalty for withdrawal, every non-performance of
the contract must be questioned on behalf of the client
without delay so that the organizer, his local delegate
or the guide can imediately find a solution for it.
HOLDING TOUR SRL cannot be held responsible for any
unexpected or unpredictable damages, occurred due to
a different management or due to the unavoidable circumstances
on behalf of the owners of the various Estates. The
client can also make a complaint by sending a registered
letter with an acknowledgment of receipt, within 10
working days and no later than the date of the client's
return home from his or her holiday.
9. One's Privacy:
In the observance of the law 675/96 one's personal
details will not be propagated to anybody else, one
can ask, at any time, to either consult, change or cancel
them.
10. Place of Jurisdiction:
This contract is regulated by the Italian law. For
any type of dispute, due to this contract, only the
court of Lecce will have jurisdiction.
